Terms of Service

1. Acceptance of Terms
By accessing or using GigTryst ("the Platform"), operated by Aashirwad Labs Private Limited, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. We reserve the right to update these terms, and continued use of the Platform after changes constitutes acceptance of the updated terms.
2. Platform Use
GigTryst is a two-sided marketplace that connects brands with influencers for content collaboration. Brands can post collaboration opportunities ("Gigs"), and influencers can apply to and fulfil those gigs. The Platform facilitates discovery, communication, deal management, and payment processing between the parties. You must be at least 18 years of age to use the Platform.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your profile information up to date. Each user may maintain only one account, and accounts may not be transferred to another person.
4. Payments and Fees
Platform fees apply on completed deals as described in your plan. For Fixed Fee deals, the platform retains a percentage of the deal value, deducted from the escrow at the time of release. For Barter++ (affiliate) deals, the platform retains a share of the declared gross merchandise value. All monetary amounts are in Indian Rupees (INR). Payment processing is handled by Razorpay in accordance with applicable regulations. Influencer subscription plans are billed monthly through Razorpay.
5. Content Guidelines
Users must comply with all applicable laws, including the Information Technology Act, 2000, and the Consumer Protection Act, 2019, as well as the content policies of connected social media platforms (Instagram, YouTube). Content that is misleading, defamatory, infringing, or otherwise unlawful is prohibited. The Platform reserves the right to remove content and suspend accounts that violate these guidelines.
6. Intellectual Property
Influencers retain ownership of the content they create. By submitting content through the Platform, influencers grant brands a licence to use the content as specified in the deal terms. The GigTryst name, logo, and platform design are the property of Aashirwad Labs Private Limited.
7. Dispute Resolution
In the event of a dispute between a brand and an influencer, either party may raise a dispute through the Platform. The Platform will review the dispute and may intervene, including releasing, holding, or refunding escrow funds as appropriate. The Platform's dispute resolution decision is final for the purposes of fund distribution on the Platform.
8. Limitation of Liability
GigTryst facilitates connections and transactions between brands and influencers but is not a party to the deals themselves. The Platform is not liable for the quality of content delivered, the accuracy of campaign results, or the commercial outcomes of any collaboration. To the maximum extent permitted by law, Aashirwad Labs Private Limited's total liability is limited to the fees paid by you to the Platform in the preceding twelve months.
9. Governing Law
These terms are governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.
10. YouTube API Services
GigTryst uses YouTube API Services to retrieve channel and content data when you choose to connect your YouTube account. By connecting your YouTube account to GigTryst, you agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.
You may revoke GigTryst's access to your YouTube data at any time through the Google security settings page at https://myaccount.google.com/permissions.
